For many years the unlawful detainer statute has required that a 3 day Notice to Pay or Vacate allows the resident 3 calendar days from the day the notice is served to either pay or move out. That meant that even if a notice was served on a weekend, holiday, etc., the time would begin running the day after service and would expire after the 3rd day, no matter if that expiration date fell on a weekend or a holiday.
Beginning on May 12, 2020, changes to the unlawful detainer statute will go into effect.
