As many of you are aware, we are waiting for HUD to come out with some guidance on the issue of Assistance Animals, particularly on Emotional Support Animals (ESA). We were told that the guidance would be out last summer. It has taken some time to get it through the process.
Recently, many advocate groups have been lobbying HUD on the guidance. The National Apartment Association (NAA) continues to work with HUD representatives on the issue. The NAA does have guidance on the issue for those that are members of the Utah Apartment Association. Forms that were created by our office in conjunction with the Disability Law Center, HUD, the Utah Anti-Discrimination Division, and others are still considered the best means of having a process to try to ferret (no pun intended) out the abusers. While HUD has not technically “approved” the forms, they are part of several conciliation agreements where HUD acknowledges that use of the forms is not a violation.
